HIPAA Enforcement Actions for Alleged Patient Confidentiality Violations are Occurring

We have seen cases in which physicians and other health care providers have received notifications of investigations from the federal department of health and human services investigating complaints of alleged violations of patient confidentiality. In conjunction with the complaint investigations, federal regulators are requesting to see the health care provider's written HIPAA compliance policies and procedures that were in effect on the date of the alleged confidentiality breach. For this reason, it is important that all health care providers which are subject to HIPAA have written policies and procedures regarding patient privacy and the security of protected health information.
